He was forced to make the tough decision after a concussion injury he suffered following a wreck at Pocono while racing for 23XI Racing. Busch, who is currently working as a mentor and consultant for Denny Hamlin’s team, has found himself in legal trouble.

The future Hall of Famer was arrested by the North Carolina Highway Patrol for DWI charges. According to the reports the traffic stop was made following Kurt Busch was caught speeding in the Brawley School Road. He was traveling 63mph in a 45mph zone in his 2024 Lexus. The arrest was made August 12 at 11:32 PM. Busch was really disappointed with the arrest.

Kurt Busch said in statement.

The deputy who made the stop reported that Kyle Busch‘s brother had “had red glassy eyes” and “a strong odor of alcohol coming from his breath,” when the stop was made. His blood-alcohol concentration was 0.17 which is more twice the allowed limit of 0.08.

This confirms driving while impaired charges on the veteran racer. It was also reported that careless and reckless driving, and speeding charges are also filed on the court against the TRD personal. Kurt Busch was held until 2.30 am in the morning at Iredell County Detention centre and was released on the condition that he would appear in court on September 19.

Kurt Busch has been arrested on the same charges before

November 2005, following his championship defence fell through, he was arrested over the same charges at Arizona. He was pulled over suspicion of DUI in Maricopa County and was arrested once the doubts were cleared.

He was ordered by the court to complete 50 hours of community service for the charges. Since the incident 20 years ago, he stayed focused on and didn’t get into similar legal trouble before August 12 incident.

It’s a slight PR mess for 23XI Racing and Kurt Busch, and they should be addressing the situation to avoid any speculation. It would be interesting to see how the legal tussle would playout for the NASCAR legend.
